As of October 1, 2023, a new form of the Maryland Statutory Financial Power of Attorney went into effect. The new law expands your agent’s powers which include, but are not limited to, the ability to (i) appoint a successor agent; (ii) make gifts on behalf of the principal to certain individual or entities within financial parameters designated (iii) open joint accounts; (iv) update beneficiary designations on various financial accounts; and (v) create and transfer property to an intervivos trust or irrevocable trust for the principal’s sole benefit. In addition, the new law allows you to elect to provide compensation to your agent with your agent’s ability to be compensated for expenses remaining the same. Although the new law does not invalidate the prior Maryland Statutory Financial power of Attorney form, it is always recommended to revisit your estate planning documents periodically to ensure they are compliant with the most current laws and your wishes.
